Terms of Service

Effective March 2026

1. Service Description

Evivant is a presales operations platform that connects to your Salesforce CRM, Google Calendar, and optionally Gong to provide automated pipeline intelligence, deal health scoring, risk detection, and prescriptive recommendations for sales engineering teams. Evivant operates in read-only mode. It reads data from your connected systems but never creates, modifies, or deletes records in Salesforce, Google Calendar, or Gong.

2. Account Terms

You must provide a valid email address and create a password to register. You are responsible for maintaining the security of your account credentials. Notify us immediately if you suspect unauthorized access.

Each registration creates one organization. The registering user becomes the Owner. Additional users may be added as Admins or Members by the Owner or an Admin.

You may use Evivant for your organization's internal business purposes. You may not resell, sublicense, or provide access to third parties outside your organization without prior written consent.

3. Data Rights & Ownership

You retain all rights to your data. Evivant does not claim ownership of any data imported from your connected systems or generated through your use of the platform.

By connecting your systems, you grant Evivant a limited, non-exclusive license to access, process, and store your data solely for the purpose of providing the service. This license terminates when your account is closed.

We will not sell, rent, share, or disclose your data to any third party except as required to operate the service (see Subprocessors in our Privacy Policy) or as required by law.

Your data is not used to train machine learning models, improve algorithms for other customers, or create derived datasets.

4. Read-Only Integrations

Evivant connects to your systems using OAuth 2.0 with minimum scopes for read-only access. If any connected system reports an issue, Evivant is not the cause — we perform no write operations. You can revoke access at any time through your system's settings.

5. Service Availability

Evivant is provided on a best-effort basis. We aim for high availability but do not guarantee specific uptime percentages at this time. We will monitor the service, communicate planned maintenance in advance, and investigate issues promptly.

We are not liable for interruptions caused by third-party providers, network conditions, or force majeure events.

6. Security

We implement industry-standard security measures including AES-256-GCM encryption for OAuth tokens, HTTPS for all data in transit, multi-tenant data isolation, role-based access control, and audit trails. See our Security Overview for details.

7. Confidentiality

Both parties agree to treat non-public information received from the other party as confidential, including your pipeline data, Evivant's proprietary algorithms, and any information marked as confidential. Confidentiality obligations survive termination for 2 years.

8. Limitation of Liability

Evivant's total liability for any claims is limited to the fees paid in the 12 months preceding the claim (or $100 during a free pilot).

Evivant is not liable for indirect, incidental, special, consequential, or punitive damages. Intelligence outputs (scores, signals, prescriptions) are informational tools, not guarantees.

9. Termination

Either party may terminate with 30 days written notice. We may suspend access immediately for terms violations or security issues.

Upon termination: you may export all data (full JSON export in Settings), Evivant deletes your data within 30 days, OAuth tokens are deleted immediately, and your account is disabled.

10. Changes

We may update these terms. Material changes are communicated to account Owners via email at least 30 days before taking effect.

11. Governing Law

These terms are governed by the laws of the State of New York.
